Brain Injuries in New Jersey

Hire an aggressive NJ personal injury attorney if you or a loved one is suffering from a brain injury.

It is estimated that 1.4 million Americans sustain traumatic brain injuries every year.
A traumatic brain injury is an injury where there is damage to the brain from an external blow to the head.  If you believe that you are suffering traumatic brain injury from an accident or personal injury incident, you should contact a New Jersey personal injury attorney like Adam H. Rosenblum.

Causes of Traumatic Brain Injury

One of the most common cause of traumatic brain injury are transportation accidents such as those involving cars, trucks, trains, buses, motorcycles and bicycles.  A significant number of brain injuries result from sports – football, baseball, skiing, skating and horseback riding.  Other causes of brain injuries include the following:

  • Falls
  • Falling objects
  • Work injuries
  • Construction injuries
  • Struck by/against objects
  • Assaults
  • Birth injuries
  • Lightning strikes
  • Electric shocks
  • Blows to the head
  • Whiplash

Signs of Traumatic Brain Injury

Because the brain is such a complex and sensitive organ, brain injuries are more complex than other injuries.  As previously discussed, a traumatic brain injury may be caused by a fall, whiplash or car accident without any direct blow to the head.  Since traumatic brain injury can occur without any clearly evident symptoms, it is important to be aware of the signs of possible traumatic brain injury.  Here is a list of such indications:

  • Tinnitus (ringing in the ears)
  • Loss of smell or taste
  • Speech problems
  • Nausea
  • Chronic tiredness/lack of motivation
  • Dizziness or loss of balance
  • Attention or memory problems
  • Confusion/getting lost
  • Chronic headache or neck pain
  • Loss of coordination
  • Increased sensitivity to light and/or sound
  • Blurry vision

Treatment of Traumatic Brain Injury

When traumatic brain injury has occurred, doctors need to stabilize the patient.   Afterwards, MRI scans, CT scans, or X-rays may be ordered to assess the level of brain damage.

Rehabilitation is another major component of treating brain injuries because it helps patients regain or manage impaired brain functions and minimizes long-term disabilities. Effective rehabilitation may enable patients to regain fundamental brain functions such as speech, memory and mobility. Rehabilitation may also benefit the patient’s family by enhancing their ability to cope with the tragedy.

Progress and Recovery

Recovery from a traumatic brain injury varies significantly.  It may take months or even years before progress or is seen.

Although the medical field does not have strong indicators on the prognosis of recovery from traumatic brain injury, there are a few:

  • The length of the coma.  The shorter the coma, the better the prognosis.
    • Amnesia.  The shorter the post-traumatic amnesia, the better the prognosis.
    • Age.  Patients over 60 or under 2 have the worst prognosis.

Case Study: $3.4 million

What makes this case unique: Suing a hospital for general negligence rather than medical malpractice; a multi-million-dollar settlement based solely on pain and suffering without even pre-trial discovery or depositions.
