Recently a respected executive was detained at Newark Liberty International Airport by Transportation Security Administration (TSA) agents after discovering a loaded handgun in his carry-on bag.  The executive stated that he accidently grabbed the wrong bag when he left his home and did not realize that he was carrying a weapon.  Needless to say the executive was charged with one count of criminal possession of a weapon and the TSA is conducting a full investigation.

Whether you brought a weapon into an airport by accident or on purpose, you can face criminal charges.  Carrying a weapon into an airport without the proper authorization is a serious crime.  Many people when they are traveling believe the laws of their home state or country are the same everywhere else.  Although you might legally have the right to carry a firearm in your home state, carrying it at New Jersey’s Newark Liberty International without authorization is a big mistake.  If you bring a weapon in a carry-on bag and attempt to board a plane, you will be facing criminal charges and fines and the TSA can impose a civil penalty and fine you up to $10,000.

The State of New Jersey has some of the strictest gun laws in America.  It is a good idea that if you own a gun and live or plan on traveling to New Jersey, you should have a good understanding of New Jersey’s gun laws.   Under NJ law, if you “knowingly have in your possession a weapon under circumstances not manifestly appropriate for lawful use,” then you will be found guilty of unlawful possession [N.J.S.A. 2C:39-5].

In New Jersey When Can I Possess A Gun?

It is against the law to knowingly possess any handgun without first having obtained a Permit to Carry.  New Jersey does not honor permits/licenses to carry a gun from any other states.  Also, it is very difficult for non-residents to obtain a permit to carry a firearm in the State of New Jersey.  Remember that you are not allowed to carry a firearm in a car without a firearm identification card and if you plan on traveling across state lines your gun must be unloaded and securely cased in the trunk of your vehicle.

Generally you may only carry a gun (handguns, rifles, shotguns) in restricted circumstances and will need firearm identification.   Assault weapons are highly restricted and all machine guns, semi-automatics and military appearance firearms are prohibited.  For more information on New Jersey gun laws please click here.
