The Real ID Deadline is Coming: What New Yorkers and New Jersey Residents Need to Know Before May 7, 2025

The Real ID Act is a law issued by the federal government that sets security standards for state-issued driver’s licenses and identification cards. Starting on May 7, 2025, a standard driver’s license will no longer be enough to board domestic flights or enter certain federal buildings. This means that a standard state-issued license will no longer be sufficient for air travel or federal facility access. While a passport will still be a valid form of identification, a driver’s license will not be accepted unless it is a Real ID.

In this article, we will discuss what a Real ID is and what it looks like, how to apply for a Real ID, common issues regarding eligibility, and the application process. One common issue while applying for the Real ID is when an applicant’s name does not match their documentation, such as their birth certificate. In these cases, an attorney at Rosenblum Law for New York or New Jersey residents can help you acquire a legal name change in order to be eligible for a Real ID.

Understanding the Real ID

Definition and Purpose

A Real ID is a federally compliant DMV-issued license, learner’s permit, or non-driver ID.

The purpose of a Real ID is to enhance safety by establishing a minimum security standard for forms of U.S. identification. The use of a Real ID was set forth by the Real ID Act, which was passed by Congress in 2005.

Identification Features

In New York, a Real ID-compliant license features a black star in the upper right corner, distinguishing it from a standard license. In New Jersey, a Real ID license displays a yellow star in the upper right corner. Additionally, standard licenses in NJ are clearly marked with “NOT FOR ‘REAL ID’ PURPOSES” to indicate that they do not meet federal requirements.

Common Issues When Getting a Real ID

When getting ready to apply for a Real ID, there are several problems that an applicant may face. First, they might have missing documents. An applicant must provide proof of identity (such as a passport or birth certificate), proof of Social Security number, and two proofs of residency. If they don’t have all of the necessary paperwork, they will not be able to apply for the Real ID until their documentation is in order.

Another common issue when applying for the Real ID is when the applicant’s name doesn’t match the name on their documentation. Discrepancies with names are possible for a multitude of reasons, such as an incorrect name being printed on a birth certificate, a name change due to a marriage or a divorce, etc. Applicants will not be able to apply for a Real ID until all documents are up to date and match the name on their primary form of identification.
Individuals unable to apply for a Real ID because of name discrepancies will need a legal name change. The attorneys at Rosenblum Law are experienced in the name change process in both New Jersey and New York. We can help individuals prepare a petition and attend court to legally change their name, making them eligible for a Real ID.
